If you want to close

We are often approached
by a client who will say to us something like “Close my company
– I can’t go on any longer!”. Well, there is a solution
out there, and if anyone can find it for you, we certainly can. In a
recession this will always be a problem, but we know from experience
that from every problem there is always a solution.
At the heart of
many failing businesses during a recession is the tendency of growing
indebtedness and a denial that this is occurring on a month by month
or quarter by quarter basis. The solution is sometimes a straightforward
Creditors Voluntary Liquidation which may or may not be accompanied
by a pre-pack sale of the assets and contracts to another business entity
which the directors then re-assume. Trading will then resume as normal
– providing the directors with continuing income and staff with
continuing employment – and a far leaner business will be able
to flourish without the encumbrance of unhealthily debt to strangle
it, as is probably the case now.
If you have a partnership
the solution may be a PVA or Partnership Voluntary Arrangement. Sole
traders may take the expedient of the better-known IVA to restructure
their finances. Whatever you legal status there is always a solution.
If you have to close
your company it does not mean that you have failed: may businesses are
closed every year – around 5,000 business are currently closing
every quarter in some way or other in the U.K. But many of these will
re-start in some form and continue to provide an income. You cannot
blame yourself from the influence of global economics; you can only
blame yourself if you don’t act now, before such action becomes
pointless.
